New York University 403(b) Excessive Fee Suit Granted Class Certification

On Wednesday, February 14, a New York federal court granted class certification in an ERISA suit brought by Schlichter Bogard & Denton on behalf of participants in two retirement plans sponsored by New York University. In granting class certification, U.S. District Judge Katherine B. Forrest found the named plaintiffs to be adequate class representatives and appointed Schlichter Bogard & Denton as class counsel of a class of more than 19,000 participants.

Schlichter Bogard & Denton’s founding and managing partner Jerome Schlichter said he was “pleased” with the Court’s ruling, noting that it was the first certification decision in any of the firm’s suits against universities.
