Who are we representing?
We are representing people who have used EzriCare and/or Delsam Pharma artificial tears and who subsequently developed an infection.
What is this investigation about?
On January 24, 2023, EzriCare, LLC first issued a statement acknowledging awareness that the Center for Disease Control (CDC) was conducting an ongoing investigation “related to adverse events implicating various Over the Counter eye drops.” [1]
On February 2, 2023, the U.S. Food and Drug Administration (“FDA”) issued a statement “warning consumers and health care practitioners not to purchase and to stop using EzriCare Artificial Tears or Delsam Pharma’s Artificial Tears due to potential bacterial contamination.” [2]
On the same day, at the FDA’s urging, manufacturer Global Pharma Healthcare Private Limited initiated a voluntary recall of all unexpired lots of EzriCare Artificial Tears and Delsam Pharma’s Artificial Tears. The company had violated several aspects of the Current Good Manufacturing Practice, including lack of appropriate microbial testing, formulation issues, and lack of proper controls concerning tamper-evident packaging. [3]
How dangerous are these artificial tears?
The CDC and the FDA have determined that the artificial tears are adulterated and contaminated with a rare, extensively drug-resistant strain of bacteria, known as Pesudomonas Aeruginosa.
This bacteria has been linked to “dozens of infections, as well as cases of vision loss and surgical removal of eyes.” To date, three deaths have been linked to this infection. [4]
