Case Study: Obtaining Justice for Children and Young Adults Harmed by Lead Poisoning
Every case tests a firm’s ability to advocate on behalf of its clients. For nearly two decades, Schlichter Bogard represented more than 1,300 Peruvian children and young adults who alleged lead poisoning and other devastating toxic injuries as children while living near the La Oroya lead smelter in Peru. What began in 2007 as a lawsuit on behalf of 17 children evolved into one of the longest-running transnational toxic tort cases litigated in U.S. courts, and ultimately resulted in Schlichter Bogard representing more than 1,300 children and young adults whose families reside in an impoverished part of Peru and who had among the highest blood-lead levels ever recorded.
Throughout the case, our attorneys overcame years of procedural, jurisdictional, and appellate challenges as billionaire defendants fought to prevent our clients’ claims from ever being heard in an American courtroom. After 19 years of battling and on the eve of the first bellwether trials, Schlichter Bogard achieved a global settlement of $150 million on behalf of our clients, bringing a historic legal battle to a close.
The significance of the case extended far beyond the courtroom. Following the resolution, Peruvian Cardinal Pedro Barreto, one of the earliest advocates for the affected Peruvian community, recognized the firm’s “nineteen years of unwavering legal advocacy” and praised the team’s perseverance on behalf of the children of La Oroya. The Cardinal further shared a personal message from Pope Leo XIV regarding the firm’s work; in his remarks, Pope Leo XIV expressed gratitude to “everyone who has worked on behalf of the population of La Oroya, especially the children,” and described the resolution as “a significant step forward, achieved after years of work.”
