Case Brought by Schlichter Bogard on Behalf of Liberty Mutual 401(k) Plan Participants Will Proceed to Trial

As reported by Law360 and other media outlets, a case brought by Schlichter Bogard on behalf of participants in Liberty Mutual’s 401(k) plan will proceed to a trial.

Last week, a U.S. District Judge denied Liberty Mutual’s attempt to obtain judgment prior to trial,  stating, in partially denying Liberty Mutual’s summary judgment motion, that the plaintiffs represented by Schlichter Bogard have a plausible claim that Defendants violated the Employee Retirement Income Security Act (ERISA).

The complaint, originally filed in April 2020, alleges that the Defendants failed to monitor recordkeeping expenses, leading to excessive fees for 50,000 participants and beneficiaries.
