Judge Denies Motion to Dismiss in Chemical Hair Straightener Multidistrict Litigation

As reported by Law 360, a federal judge in Illinois has ruled that consumers alleging harm from chemical hair relaxers can proceed with most of their consolidated claims, which include claims for negligence, design defects, failure to warn, breach of warranty, unjust enrichment, and wrongful death. The judge largely rejected the defendant companies’ attempts to dismiss the litigation, which concerns serious injuries that consumers allege to have suffered as the result of using hair relaxer products. Plaintiffs assert that hair relaxer products cause or increase the risk of reproductive system injuries, including uterine, ovarian, and breast cancer.
