Health Data Privacy Lawsuit Against Cigna Brought on Behalf of Plaintiffs Represented by Schlichter Bogard Will Proceed

As reported by Law360, a federal judge in Pennsylvania has allowed a proposed class action led by Schlichter Bogard against Cigna to proceed, rejecting the company’s efforts to dismiss most claims alleging that insureds’ protected health information was unlawfully disclosed through tracking technology embedded in Cigna’s online portals.

The lawsuit, brought on behalf of Cigna health plan participants represented by Schlichter Bogard, alleges that information regarding users’ health conditions and treatments was shared with third parties for marketing purposes without the consent required by law. The court allowed plaintiffs’ claims for breach of fiduciary duty, unjust enrichment, and violations of federal and state wiretapping laws to move forward.

In the article, Schlichter Bogard Co-Managing Partner Andrew Schlichter stated, “We’re pleased the court found that the bulk of our claims will move forward. Insureds are entitled to expect that their private health information will be protected, and we look forward to proving the case at trial.”
