U.S. Court of Appeals for the Eleventh Circuit Rules That Class Action Brought by Schlichter Bogard on Behalf of Current and Former Inland Fresh Workers May Proceed, Overturning Circuit Precedent

As reported by Reuters, the U.S. Court of Appeals for the Eleventh Circuit has revived a class action brought on behalf of current and former Inland Fresh workers represented by Schlichter Bogard and, in the process, overturned longstanding precedent.

The case involves allegations that fiduciaries of Inland Fresh’s employee stock ownership plan breached their duties to current and former employee plan participants. The Eleventh Circuit’s decision not only reinstates the claims brought on behalf of current and former workers, but also lowers a procedural barrier for participants seeking to bring similar claims.

In the article, Schlichter Bogard Co-Managing Partner Andrew Schlichter stated, “We are pleased with the circuit court’s opinion allowing the claims to proceed and look forward to the opportunity to prove the complaint’s allegations of wrongdoing in the district court.”
