Groundbreaking Lawsuits Filed by Schlichter Bogard Seek to Protect the Personal Data of Retirement Plan Participants
As described in a recent Law360 article, groundbreaking new lawsuits have been filed by Schlichter Bogard & Denton, including against Shell Oil Co. and ADP TotalSource, that challenge employers’ data privacy policies and retirement plan recordkeepers’ use of participant data to cross-market non-plan products.
An attorney and American Retirement Association executive who has written about the ADP lawsuit said these new cases filed by Schlichter Bogard & Denton raise questions about whether employers “even know what their record-keepers are doing” with plan participants’ data. “As a plan fiduciary, as an employer, you would want to know that,” the executive said.
