Illinois Residents Represented by Schlichter Bogard Secure Class Certification in Apple Biometric Privacy Case

As reported by Law360, a U.S. District Judge has certified a class of Illinois residents in a lawsuit alleging that Apple Inc. violated the Illinois Biometric Information Privacy Act (BIPA). The plaintiffs are represented by Schlichter Bogard, which was appointed as class counsel.

The case centers on allegations that Apple’s Photos app used facial recognition technology to create biometric “faceprints” of users without obtaining the consent required under BIPA. The court found that key questions can be resolved on a classwide basis, including whether Apple collected and used biometric data without proper authorization.
