Jerry Schlichter Interviewed About the Evolving Landscape of Employee Benefits Litigation

Schlichter Bogard Co-Managing Partner Jerry Schlichter was featured in a Law360 interview discussing the evolution of ERISA litigation, recent developments in retirement plan cases, and the fiduciary obligations owed to workers and retirees.

Among other topics, Jerry reflected on the firm’s recent litigation successes, including the proposed settlement of litigation involving the ADP 401(k) Plan and a $150 million settlement resolving claims brought on behalf of more than 1,300 Peruvian plaintiffs exposed to toxic lead emissions.

The interview also addresses Schlichter Bogard’s pioneering role in excessive-fee litigation and emerging litigation involving pension risk transfers. Reflecting on the firm’s approach to ERISA cases, Jerry noted that Schlichter Bogard spent nearly two years studying the retirement-plan industry before filing its first lawsuit and highlighted the broader impact of that work, stating that “Federal judges have said we’ve educated the [Department of Labor] on its duties” and emphasizing the role litigation has played in bringing greater attention to retirement-plan fees and fiduciary practices.
